Acceptance of Terms

1.1 Binding Agreement. By accessing, utilizing, registering for, or engaging with the AIPHOTOBOOTH service in any manner, you hereby acknowledge and expressly consent to be bound by all provisions contained herein.

1.2 Capacity to Contract. You affirm that you possess the legal capacity to enter into binding contractual relationships in your jurisdiction. If utilizing the Service on behalf of a business entity, you warrant that you possess the requisite authority to bind said entity.

1.3 Modification Framework. AIPHOTOBOOTH maintains the right to modify this Agreement at any time. Such modifications become effective immediately upon posting. Your continued use constitutes acceptance.

Service Description

2.1 Service Parameters. The Service utilizes artificial intelligence technologies to generate photographic alterations, enhancements, and transformations based on User-provided content.

2.2 Credit-Based System. The Service operates on a prepaid credit-based system. Users must purchase credits prior to utilizing certain functionalities. Credit pricing may be modified without prior notification.

2.3 Technical Limitations. AIPHOTOBOOTH makes no warranties regarding continuous availability, reliability, or accuracy of the Service.

Payment Terms

3.1 Credit Acquisition. Users may purchase credits through designated payment mechanisms, either as one-time credit packs and plan unlocks or through the monthly Pro subscription. One credit is consumed per generated photo for Live Edit (Lite and Pro), Face Swap and Style Transfer; virtual try-on, realtime video, painting and AI video animation consume credits at the rate displayed in the dashboard before use.

3.2 Credit Expiration. Credits obtained through credit packs or plan unlocks do not expire while the account remains active. Credits included in a subscription period expire at the end of that period and are reset, not accumulated, at each renewal. Welcome credits granted at signup expire ninety (90) days after registration if no purchase has been made. Expired credits shall be forfeited without compensation.

3.3 Pro Subscription. The Pro subscription is billed monthly in advance at the price displayed at checkout and renews automatically each month until cancelled. Each paid period grants the number of credits displayed at checkout (currently 300), unlocks the Pro feature set for the duration of the period and entitles the subscriber to the subscriber rate on credit packs. You may cancel at any time from the billing page; cancellation takes effect at the end of the current paid period, during which the Service remains available. No partial refund is issued for the remainder of a paid period. If a renewal payment fails, AIPHOTOBOOTH may retry the charge and, after the retry period configured by the payment provider, end the subscription; remaining subscription credits are forfeited when the subscription ends. Credits obtained through credit packs are not affected by the end of a subscription. Where the number of active photobooths exceeds the limit of the plan the account falls back to, the excess photobooths are deactivated (most recently used first kept); no content is deleted.

3.4 Right of Withdrawal. Credits, plan unlocks and subscription periods are digital content that is made available immediately after payment. Where you purchase as a consumer in the European Union, you expressly request that the digital content be provided before the end of the fourteen (14) day withdrawal period and acknowledge that you thereby lose your right of withdrawal, in accordance with Article 16(m) of Directive 2011/83/EU. This consent is collected as a separate, express confirmation at checkout.

3.5 Prices and Taxes. Prices are displayed in euros and include value added tax (VAT) where applicable. Business customers who provide a valid EU VAT identification number at checkout are invoiced under the reverse charge mechanism where the law so permits. Prices displayed in another currency are indicative conversions; the amount charged is the euro price. Credit and subscription pricing may be modified for future purchases and renewals with notice on the pricing page; a price change applies to a running subscription from its next renewal after the notice.

3.6 Photo Sales. Where you sell photos to guests through the Service using your own connected payment account, you are the merchant of record for those sales. AIPHOTOBOOTH does not charge a commission on such sales; payment processing fees of the payment provider remain payable by you.

User Obligations

4.1 Compliance. You agree to comply with all applicable laws and regulations.

4.2 Account Security. You are responsible for maintaining the confidentiality of your account credentials.

4.3 Prohibited Activities:

• Violating any applicable laws or third-party rights
• Creating unlawful, harmful, or objectionable content
• Attempting to circumvent security features
• Reverse engineering any aspect of the Service
• Uploading viruses or malicious code

4.4 Content Restrictions. You agree not to create content that infringes IP rights, contains explicit material, promotes discrimination, exploits minors, or facilitates illegal activities.

4.5 Data Protection Roles at Events. When you use the Service to process photos of guests at your events, you (or your own customer, where applicable) act as the data controller for guest personal data, and AIPHOTOBOOTH acts as a processor on your behalf. A data processing agreement covering this processing is available on request at hello@aiphotobooth.eu.

4.6 Guest Information and Consent. You are responsible for informing guests about the processing of their photos and for obtaining any consent required under applicable law before guests use the Service at your events.

4.7 AI Transparency Disclosure. Images and videos produced by the Service are artificially generated or manipulated by AI. As the operator deploying the Service, you are responsible for disclosing this to guests clearly and at the latest when they first see the content, as required by Article 50(4) of the EU AI Act, including through signage at the venue and in any distribution of the content. AIPHOTOBOOTH provides standard disclosure wording (AI Transparency Disclosure Kit) on request.

4.8 Indemnity. You agree to indemnify and hold AIPHOTOBOOTH harmless from any third-party claims, damages, and reasonable legal costs arising out of your events, your breach of the obligations in this Section 4, or content created through your use of the Service.

Intellectual Property

5.1 Service Ownership. The Service and all IP rights therein are owned by AIPHOTOBOOTH or its licensors.

5.2 User Content. You retain ownership of content you upload. By uploading, you grant AIPHOTOBOOTH a worldwide, royalty-free license to use such content in connection with the Service.

5.3 Generated Content. Subject to compliance with this Agreement, you are granted ownership rights to content generated through your use of the Service.

Termination

6.1 By User. You may terminate by ceasing use and deleting your account. Remaining credits will be forfeited and any running subscription is cancelled without refund of the current period.

6.2 By AIPHOTOBOOTH. We reserve the right to suspend or terminate your access, with or without notice, for any reason including violation of this Agreement.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. AIPHOTOBOOTH DOES NOT WARRANT THAT THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR ERROR-FREE. GENERATED CONTENT MAY PRODUCE UNPREDICTABLE RESULTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIPHOTOBOOTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Our total liability shall not exceed the fees paid by you during the six (6) months preceding the occurrence of the damage.

Governing Law

This Agreement shall be governed by the laws of the Republic of Lithuania, without prejudice to mandatory provisions of applicable European Union law.

Disputes shall be subject to the exclusive jurisdiction of the courts of the Republic of Lithuania, unless mandatory law provides otherwise.
